These terms and conditions govern the selling at a distance of goods by means of the website accessible through the URL www.rollart.it (hereinafter, the “Site”) and the distance selling of goods as requested by Customers through specific personalization. These general conditions of sale (hereinafter, the “General Conditions for on-line sales”) are in compliance with the Legislative Decree as of 6th September 2005, n. 206 (“Consumers Code”), with particular reference to Section II, and with the Legislative Decree as of 9th April 2003, n.70 implementing the EU Directive on Information Society Services (so-called “E-Commerce Directive”).
These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with www.rollart.it website (the “Service”) operated by RollArt di Medbcreateam S.r.l. (“us”, “we”, or “our”).
Please read these Terms and Conditions carefully before using the Service.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
1.Acceptance of General Sales Terms and Electronic Signature
The Customer, with their purchase order, unconditionally accepts and agrees to comply with his/her dealings with RollArt, the general conditions and payment arrangements set out below, claiming to have read and accepted all the information provided to him/her.
Placing order confirmations therefore implies a full acknowledgement of these Terms and their full acceptance.
Bear in mind that clicking on the “confirm” button is an electronic signature.
This electronic signature has the same value as a handwritten signature.
The sales contract between the Customer and RollArt di Medbcreateam S.r.l. is concluded in Italy and hence governed by Italian law.
2 Purchases
If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.
You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.
By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.
3.Costs
The purchase is made by the Customer and is relevant to the products as shown and described in the on-line descriptions (images are approximate).
The purchase price is fixed and definitive. However, it does not include shipping, considered separately, that will be indicated and paid for during checkout.
Prices are deemed to be Italian VAT included, according to Italian tax applied to sales to private individuals and do not include customs fees which are paid by the recipient, as customs duties and charges are subject to the customs laws of receiving country.

4.Payments and billing
The payment of the purchased products and their shipping costs will be paid by the Customer through Credit Card or Bank Transfer. (The various options on payment will be further specified during checkout).
Payment by bank transfer is subject to the following conditions:
The bank transfer must be received within 10 working days of the order being executed. After that date the order will be considered void. The goods will only be shipped after verification of bank transfer to our account.
The products ordered remain the property of RollArt di Medbcreateam S.r.l. until they are fully paid for together with (in accordance with Art. 1523 of the Italian Civil Code.) shipping costs as indicated at the time of purchase (checkout).
RollArt di Medbcreateam S.r.l. has the right to claim its goods back in case of non-payment, in this case, and at the request of RollArt di Medbcreateam S.r.l., the Customer agrees to return any unpaid products, at their own expense.
Each order for products sent to www.rollart.it constitutes a contract proposal to the Customer.
The tax records relating to the Products ordered will be issued by RollArt di Medbcreateam S.r.l. at the time of shipment of the Products to Customer.
The Customer agrees to provide the exact shipping and billing address, hence in case of incorrect or partial data any additional recovery fees or other costs will be borne by the Customer.
5.Shipping
Products purchased will be delivered directly from RollArt di Medbcreateam S.r.l. via courier or carrier to the address stated by the Costumer as the shipping address.
At the time of order, the Costumer undertakes to provide the correct address of delivery and a valid telephone number.
For our shipping we rely on the services of qualified express couriers such as DHL to ensure service quality and integrity of products.
The duly packed goods travel on behalf and at the risk of the buyer from the moment they are delivered to the carrier for shipping.
On the moment of delivery the Customer must check the integrity of the shipped packages.
In the event of delays, damages, total or partial loss of purchased goods, the Customer is entitled to appeal to the Customer’s courier with RollArt di Medbcreateam S.r.l. taking no responsibility for the matter.
Therefore, upon delivery, www.rollart.it recommends Customers to proceed to verify the condition of the goods delivered before signing the acknowledgment of receipt of the package. Once signed, they will not be able to contest any damage or aesthetic abnormalities found on the products. We remind Customers that it is their right to open the contents of the packaging if signs of damage to the packaging are to be reported.
If you notice or find any anomalies in the products, you must refuse delivery of the products or accept them by writing in a receipt of reservations with specific details and dates. A copy will be addressed to RollArt di Medbcreateam S.r.l. – Via Col di Lana 2-20020 – Dairago – MILAN – Italy.
Normally deliveries are made within 7 working days for Italy and 10-15 days for Europe and 15 for any countries located outside the European Union, only for products in stock.
The delivery of products not available in stock will be made within 3-5 weeks of receiving payment.
Delivery times are indicative if there are no physical or structural impediments (e.g. incorrect addresses) or force majeure events such as strikes, problems related to transportation-delivery-manufacture, fluctuations in exchange rates, governmental actions and/or regulations.
Delivery is deemed to be effected from the moment the Product is delivered to the Customer. The delivery document issued by the carrier, dated and signed by the Customer upon delivery of the product, will be the proof for the transport and release of the goods.
The delivery of products, unless otherwise specified, will always be carried out at the ground floor.
The Customer, by purchasing, accepts these conditions.
6.Product retrieved in case of absence of Customer
In case of absence of the consignee during delivery, the carrier will leave a notice of change to the delivery address indicated by the Customer. Products must be picked up at the address and in the manner indicated by the carrier. During shipment all the instructions to track the shipment and check delivery times will be provided to the Customer.
In case of failure to collect sent goods within the time limit set down by the conveyor, the products will be returned to RollArt di Medbcreateam S.r.l. and in this case the Customer will not be entitled to any refunds at all. In addition, any expenses related to the transportation of returned products to RollArt di Medbcreateam S.r.l. will be charged to the Customer.
7.Right of withdraw
The Customer has the right to withdraw from the order, without any penalty and without specifying the exact reason, not more than 48 hours from when the order has been performed. The right of withdrawal must be exercised by the Customer, by sending a registered letter with a return receipt to RollArt di Medbcreateam S.r.l. – Via Col di Lana 2-20020 Dairago (MI) – Italy
The above-mentioned communication can be sent, within the same period, by fax or email to info@rollart.it RollArt di Medbcreateam S.r.l. +39 0331.486997, if confirmed by registered letter, within 48 (forty eight) hours of sending the mail or fax.
8.Returning an item
The Customer may not return any item due to its non-prefabricated nature which are based on the individual choice of the Customer. In addition, current law states that the right of returning goods cannot be exercised for “goods made to an individual choice or clearly personalized“; the products of our catalogue are all made to individual Customer choices or clearly personalized.
9.Technical assistance
RollArt di Medbcreateam S.r.l. guarantees the ‘integrity of the materials and the products upon delivery’.

10.Privacy Policy
RollArt di Medbcreateam S.r.l. is the holder of the personal data collected at the time of registration to the site as well as of those subsequently communicated at the time of purchase by the Customer, except for the data relating to the payment procedure for which reference is made to the banking institutions through which the transaction is made. For any information regarding the processing of personal data, including the rights referred to in Art. 7 of Legislative Decree no.196/03, please refer to the information already provided detailed on the site www.rollart.it .
By purchasing our goods the Customer accepts these conditions and renounces any claims to RollArt di Medbcreateam S.r.l.
11.Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of RollArt di Medbcreateam S.r.l. and its licensors. The Service is protected by copyright, trademark, and other laws of both Italy and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of RollArt di Medbcreateam S.r.l.

Our Service may contain links to third-party web sites or services that are not owned or controlled by RollArt di Medbcreateam S.r.l.
RollArt di Medbcreateam S.r.l. has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. The Customer further acknowledges and agrees that RollArt di Medbcreateam S.r.l. shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

13.Limitation Of Liability
In no event shall RollArt di Medbcreateam S.r.l., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) the Customer’s access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed in its essential purpose.

The use of the Service is at the Customer’s sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether expressed or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
RollArt di Medbcreateam S.r.l. its subsidiaries, affiliates, and its licensors do not warrant that: a) the Service will function uninterruptedly, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.
15.Governing Law
These Terms shall be governed and construed in accordance with Italian Law, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a Court of Law, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
16.Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to these new terms, please stop using the Service.

Le presenti condizioni generali di vendita hanno per oggetto la definizione dei diritti e degli obblighi delle parti nel contesto di una vendita a distanza di beni proposti nel negozio on line www.rollart.it
in conformità alla vigente disciplina sul commercio elettronico e i contratti a distanza.
Nessun’altra condizione generale o particolare comunicata dal Cliente potrà inserirsi o esulare dalle presenti condizioni generali.
Il cliente dichiara, di avere preso visione di tutte le suddette informazioni e condizioni generali di vendita, prima di effettuare l’ordine.
1.Accettazione Condizioni generali di Vendita e Firma elettronica
Il cliente, con il proprio ordine di acquisto, accetta incondizionatamente e si impegna ad osservare nei suoi rapporti con RollArt, le condizioni generali e di pagamento di seguito indicati, dichiarando di aver preso visione ed accettato tutte le indicazioni a Lui fornite.
L’inoltro della conferma dell’ordine pertanto implica la totale conoscenza di tali Condizioni Generali di Vendita e la loro integrale accettazione.
Il “clic di convalida” costituisce una firma elettronica.
Questa firma elettronica ha tra le parti lo stesso valore di una firma manoscritta.
Il contratto di vendita tra il Cliente e RollArt di Med B createam s.r.l. si intende concluso in Italia e regolato dalla legge italiana.
2.Costi
L’acquisto è effettuato dal cliente ed è relativo ai prodotti così come illustrati e descritti ON-LINE nelle relative schede descrittive (le immagini sono indicative).
Il prezzo stabilito all’acquisto è fissato e definitivo. Esso non include le spese di consegna, considerate a parte, che saranno indicate e pagate nella conferma d’ordine.
I prezzi sono considerati inclusi IVA italiana, come da tassazione italiana applicata per vendita a privati e sono esclusi gli oneri doganali che sono a carico del destinatario, in quanto i dazi e oneri doganali sono soggetti alle leggi doganali di ogni Parse di destinazione e in continua evoluzione.

3.Pagamenti e fatturazione
Il pagamento dei prodotti acquistati e delle relative spese di spedizione dovrà essere effettuato dal cliente con queste modalità: Carta di Credito o Bonifico Bancario. (Le varie opzioni sugli strumenti di pagamento verranno ulteriormente specificate durante la procedura di acquisto).
Il pagamento con bonifico bancario è sottoposto alle seguenti condizioni:
Il bonifico bancario dovrà pervenire entro 10 giorni lavorativi dall’effettuazione dell’ordine. Oltre tale data l’ordine sarà considerato nullo. La merce verrà spedita solamente dopo aver verificato l’avvenuto accredito presso il nostro c/c bancario.
I Prodotti ordinati rimangono di proprietà di RollArt di Med B createam s.r.l. fino al pagamento definitivo e per intero del loro prezzo (ai sensi Art. 1523 e seguenti del CC.) e delle spese di spedizione come indicate al momento dell’acquisto.
RollArt di Med B createam s.r.l. si riserva il diritto di rivendicare i Prodotti ordinati in caso di mancato pagamento, in questa ipotesi e su richiesta di RollArt di Med B createam s.r.l., il Cliente si impegna a restituire qualsiasi Prodotto non pagato, con spese a proprio carico.
Ciascun ordine dei Prodotti trasmesso a rollart.it costituisce proposta contrattuale del Cliente.
La documentazione fiscale relativa ai Prodotti ordinati verrà emessa da RollArt di Med B createam s.r.l. al momento della spedizione dei Prodotti stessi al Cliente.
Il cliente acquirente si impegna a fornire le esatte indicazioni per l’indirizzo di spedizione e di fatturazione; in caso di invio errato di tali dati tutti gli eventuali costi aggiuntivi di recupero e rispedizione sono a carico del cliente acquirente.
4.Modalità e Tempi di Spedizione
I prodotti acquistati saranno consegnati dalla RollArt di Med B createam s.r.l. per mezzo corriere o trasportatore, all’indirizzo indicato dal Cliente come indirizzo di destinazione.
Il Cliente si impegna al momento dell’ordine a fornire il corretto indirizzo dove recapitare la merce e un recapito telefonico valido.
Per le nostre spedizioni ci affidiamo al servizio di corrieri espressi qualificati quali DHL per garantire la qualità del servizio e l’integrità dei Prodotti.
La merce debitamente imballata viaggia per conto e a rischio dell’acquirente fin dal momento della consegna al vettore.
Al momento della consegna il cliente deve verificare l’integrità dei colli.
In caso di ritardi, avarie, perdite totali o parziali, è facoltà del cliente fare ricorso al trasportatore senza che la responsabilità di rollArt.it venga mai presa in causa.
Pertanto, alla consegna, RollArt.it raccomanda al cliente di procedere alla verifica dello stato dei prodotti consegnati prima di firmare l’avviso di ricezione del pacco. Una volta apposta la firma di accettazione, non sarà più possibile contestare eventuali danneggiamenti o anomalie estetiche riportate sui prodotti. Ricordiamo ai clienti che è nel loro dovere aprire il contenuto dell’imballo qualora vi fossero riportati dei segni di danneggiamento sull’imballo.
Qualora constatasse delle anomalie nel prodotto, deve rifiutare la consegna dei prodotti o accettarli mettendo per iscritto nell’avviso di ricezione le proprie riserve, dettagliate e datate. Una copia verrà indirizzata a RollArt – presso Med B createam S.r.l. – via privata Col di Lana 2 – 20020 – Dairago – MILANO – Italy.
Di norma le consegne avvengono nell’arco di 7 giorni lavorativi per l’Italia e 10/15 giorni per Europa e 15 per il resto dei Paesi fuori unione Europea, solo per i prodotti disponibili a magazzino.
Le consegne per prodotti non disponibili in magazzino avvengono entro 3/5 settimane dal ricevimento dell’accredito.
I tempi di consegna sono indicativi qualora non sussistano impedimenti fisici o strutturali (es: indirizzi non corretti) o eventi di forza maggiore quali scioperi, calamita’ naturali, problemi relativi a trasporto/fornitura/fabbricazione, oscillazioni del tasso di cambio, azioni governative e/o regolamentari.
La consegna viene considerata come eseguita dal momento in cui il Prodotto viene consegnato al Cliente. Il documento di consegna rilasciato dal trasportatore, datato e firmato dal Cliente alla consegna del Prodotto, costituirà una prova in materia di trasporto e rilascio del bene.
La consegna dei prodotti, se non diversamente specificato, si intende sempre al piano strada.
Il cliente, acquistando, accetta le presenti condizioni.
4.Ritiro dei prodotti in caso di assenza del cliente
In caso di assenza del destinatario durante la consegna, il trasportatore lascerà un avviso di passaggio all’indirizzo di consegna indicato dal cliente. I prodotti dovranno essere ritirati all’indirizzo e secondo le modalità indicate dal trasportatore. Al momento della spedizione verranno fornite al cliente tutte le indicazioni per rintracciare la spedizione e verificare i tempi di consegna.
In caso di mancato ritiro entro il termine stabilito dal trasportatore, i prodotti verranno restituiti a RollArt di Med B createam S.r.l. e in tal caso il cliente non avrà diritto ad alcun rimborso. Le spese relative al trasporto dei prodotti di rientro alla RollArt di Med B createam S.r.l. saranno a carico del cliente.
5.Diritto di Recesso
Il consumatore ha il diritto di recedere dall’ordine effettuato, senza alcuna penalità e senza specificarne il motivo, entro e non oltre, 48 ore dall’ordine effettuato. Il diritto di recesso dovrà essere esercitato dal Cliente, a pena di decadenza, mediante invio di lettera raccomandata a.r. a RollArt di Med B createam s.r.l. – via privata Col di Lana 2 – 20020 Dairago (MI) – Italy
La comunicazione di cui sopra può essere inviata, entro lo stesso termine, anche mediante mail a info@rollart.it o fax RollArt di Med B createam s.r.l. +39 0331.486997, purché confermata, mediante lettera raccomandata a.r., entro le 48 (quarantotto) ore successive all’invio della mail o fax.
6.Politiche di Reso e Recesso
Il consumatore non può esercitare il diritto di recesso e/o reso per gli ordini effettuati, in quanto si tratta di bene non prefabbricato prodotto in base ad una scelta individuale del consumatore, (l’attuale dicitura di legge recita che il diritto di recesso non è esercitabile per “beni confezionati su una scelta individuale o chiaramente personalizzati”):i prodotti del nostro catalogo rientrano in questa casistica.
7.Assistenza Tecnica
RollArt di Med B createam s.r.l. garantisce l’ integrità dei materiale e dei Prodotti al momento della consegna.

8.Protezione dei dati personali
RollArt di Med B createam s.r.l. è titolare dei dati personali raccolti al momento della registrazione al sito, nonché di quelli successivamente comunicati al momento dell’acquisto da parte del cliente, eccezion fatta per i dati relativi alla procedura di pagamento per i quali si rimanda agli istituti bancari attraverso i quali avviene la transazione. Per le informative relative al trattamento dei dati personali, ivi inclusi i diritti di cui all’art. 7 del D. lgs. 196/03, si rinvia all’informativa dettagliata già fornita all’interno del sito www.rollart.it .
Acquistando il cliente accetta tali condizioni e tiene Rollart di Med B createam s.r.l. indenne da qualsiasi rivalsa o pretesa di istruzione di dettaglio.
9.Diritti di proprietà intellettuale ed industriale
Rollart informa che il sito e tutti i proposti, sono protetti dai diritti di proprietà intellettuale e industriale applicabili e che ne è vietata ogni tipo di riproduzione, comunicazione, distribuzione, pubblicazione, alterazione o trasformazione, in qualsiasi forma e per qualsiasi scopo esse avvengano Rollart di Med B createam s.r.l. si riserva la facoltà di agire legalmente per tutelare tali aspetti.
